This document outlines the agreement between you (“The Traveler”) and Tour Architex (“The Company”). By confirming your journey, you agree to these terms.

1. The Booking Agreement

1.1 Custom Journey Design

Tour Architex provides personalized travel architecture and design services. Upon engaging The Company, The Traveler agrees to pay a non-refundable Design Fee (or Planning Fee) for the creation of their custom itinerary, regardless of whether the final journey is booked.

1.2 Scope of Services

The Company agrees to provide expert consultation, itinerary creation (the “Blueprint”), securing of ground services (accommodations, transfers, private guides, and agreed-upon experiences), and 24/7 logistical support during the journey. Unless expressly stated, T&Cs exclude international airfare.

2. Payments, Deposits, and Confirmation

2.1 Deposits and Initial Payment

A non-refundable Initial Deposit (or Design Fee) is required to commence the planning phase. This fee is non-transferable and secures The Company’s time and expertise in designing the initial journey Blueprint.

2.2 Payment Schedule 

The Traveler agrees to follow the payment schedule below. Failure to meet payment deadlines may result in the cancellation of components or the entire journey.

  • Payment 1 (Initial): 20% due upon agreement to start the planning.

  • Final Payment: The remaining balance is due 30 days prior to the departure date.

2.3 Pricing and Currency

All pricing will be quoted in US Dollars (USD) unless otherwise specified. Prices are subject to change until the final payment is received due to supplier rate changes or currency fluctuations.

3. Cancellations and Refunds

3.1 Cancellation by The Traveler

All cancellations must be submitted in writing to The Company. Refunds are subject to the following schedule, plus any non-refundable fees assessed by third-party suppliers (hotels, guides, airlines, etc.). The Initial Design Fee is always non-refundable.

3.2 Changes to the Journey

While we architect for flexibility, changes requested by The Traveler after the Final Payment may incur a Service Fee of $300 USD plus any penalties imposed by suppliers.

3.3 Cancellation by The Company

The Company reserves the right to cancel a journey due to unforeseen circumstances (e.g., political instability, natural disaster). In such cases, The Company will offer a full refund or credit for a future journey, less any unrecoverable third-party costs.

4. Traveler Responsibility

4.1 Travel Documents and Insurance

The Traveler is solely responsible for obtaining and holding valid passports, visas, and all necessary travel documentation. Travel insurance is mandatory for participation in any Tour Architex journey and must cover cancellation and medical emergencies.

4.2 Health and Conduct

The Traveler must inform The Company of any health conditions or physical limitations that may affect their participation. The Company reserves the right to terminate a journey for any Traveler whose conduct disrupts the safety or enjoyment of the local community or The Company’s staff.

5. Legal and General Provisions

5.1 Governing Law

This agreement is governed by the laws of  the State of New York.

5.2 Limitation of Liability

Tour Architex, acting as a travel designer, is not liable for any acts, omissions, or defaults of independent third-party suppliers (including hotels, carriers, and local operators). The Company’s liability for any claim shall not exceed the total cost paid for the journey.
